Standard Trading Terms and Conditions

1 DEFINITIONS
In this document the following words shall have the following meanings:

1.1 "Buyer" "you" or "yours" means the organisation or person who buys Goods from the Seller.
1.2 "Goods" means the articles to be supplied to the Buyer by the Seller.
1.3 "List price" means the list of prices of the goods maintained by the Seller as amended from time to time.
1.4 "Seller", "we" or "us" means Deodorant 4 Allergy, 38 Mountfield Road, Irthlingborough NN9 5SY

2 PRICE AND PAYMENT
2.1 The price shall be that in the Seller's current published Price List, or such other price as the parties may agree in writing. The Seller's current published Price List Prices supersedes all others and are subject to change without notice.
2.2 The price is exclusive of VAT or any other applicable costs. Carriage shall be paid for by the buyer unless otherwise agreed.
2.3 Goods will be dispatched quickly after payment by credit card, debit card, Paypal or bank transfer has been cleared. If payment is by bank transfer please use your name and/or invoice number as a reference.
2.4 The Seller is entitled to charge interest on overdue invoices from the date when payment becomes due from day to day until the date of payment at the rate of 2.5% per annum above the base rate of the Bank of England.
2.5 Drop ship customers may only order online and must make advance online payment at time of ordering.
2.6 When you receive an email confirmation of order from us, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
2.7 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) If there has been a pricing or product description error; or
(d) If you do not meet any eligibility criteria set out in our terms and conditions.


3 DELIVERY
3.1 Date of delivery specified by the Seller is an estimate only. Time of delivery shall not be of the essence of the contract unless expressly stated.
3.2 Carriage is charged by weight as shown on the website for delivery to mainland UK.
3.3 Orders to the extremities or islands of the UK may carry an additional shipping charge. Orders to Jersey, Gurnsey or outside the UK can only be made offline.
3.4 Your order will be despatched 1 to 2 working days after day of receipt unless we inform you otherwise. The 1st attempted delivery then normally additionally takes 1-2 additional days. These times are not guaranteed but under normal conditions delays are rare.
3.5 All delivery services have tracking facilities included. A signature on delivery will be required.
3.6 If delivery is not possible a calling card should be left for you to either arrange re-delivery when someone will be in or for you to collect from the delivery depot. If you do not contact the carrier soon after the 1st attempted delivery your goods may be returned to Deodorant 4 Allergy, your order cancelled & any postage paid will be non refundable.
3.7 The buyer is to inform the seller if goods have not arrived within a week without explanation.
3.8 Our stock system should ensure you cannot order an out of stock item. Should there be a rare fault with the stock system that allows you to order a stock-out item we will contact you and give you the choice of:
a) Waiting for a re-stock (we will advise you how long)
b) The option to part cancel your order if you would rather not wait. If you decide to part cancel we will refund the difference by cheque, bank transfer or Paypal.


4 TITLE
4.1 Title of goods passes from the buyer to the seller after cleared payment is received in full and the goods have been dispatched to the carrier.

5 BREAKAGES, SHORTAGES AND DAMAGES
5.1 Breakages, shortages or damages must be reported to us within 2 working days (excludes weekends, bank holidays) of delivery. If the outer packaging is damaged on receipt, you should refuse the delivery or document it with the carrier on delivery.
5.2 Credit (against next order) rather than replacement is given for all breakages, shortages, returns or damages.
5.3 Please be aware that we do not as a rule post credit notes out.
5.4 A credit note is made against your record and this will be applied against your next order.
5.5 Special offer items returned and accepted for refund will have the value of its associated special offer (at time of purchase) deducted from the refund.
5.6 Proof of posting of any returns does not constitute proof of delivery (we advise you to return by signed for delivery).

6 CANCELLATION
6.1 Orders cancelled after despatch will be subject to any charges incurred by the Seller.
6.2 The Goods must be returned to the seller within 5 working days of receipt at the Buyers expense otherwise the Buyer agrees to accept the Goods and must pay for them in full.

7 GENERAL
7.1 Terms are subject to change without a notice period, we will notify you on this page if there are any changes.
7.2 Tawas Crystal is not a medical treatment/cure & resellers must not make claims to the contrary.
7.3 We reserve the right to terminate any account for any reason without notice. This will usually be, but not confined to breach of terms & conditions of trade or websirte use, inactivitity or low activity..
7.4 We are registered for VAT. Our VAT number is 940 1597 28. All prices are shown on the website exclusive of VAT at 15%. VAT will be added to the final bill at 15%.
7.5 These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
7.6 If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
7.7 Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.
